PERM Labor Certification (EB-2 & EB-3)
A permanent labor certification (“PERM”) issued by the Department of Labor (“DOL”) allows an U.S. employer to permanently hire a foreign worker (aka sponsor the worker for a green card). Before the U.S. employer can submit a green card application to USCIS, the employer must demonstrate to DOL that no U.S. workers are able, willing, qualified or available to accept the job opportunity in the area of intended employment, and that they will pay a fair wage to avoid undercutting the U.S. labor market. EB-1 Multinational Manager
The EB-1 Multinational Manager green card allows the employer to by-pass the PERM Labor Certification process. This green card is meant for international executive and managerial employees of multinational companies. The executive manager must have been employed in a managerial/executive capacity for at least one year in the past three outside the U.S. by a foreign affiliate of the U.S. sponsoring employer. EB-1 Individual with Extraordinary Ability
The EB-1 Individual with Extraordinary Ability classification is a labor certification exempt immigrant visa category available both to self-petitioners and to businesses, universities and non-profit organizations seeking to sponsor employees with an extraordinary track record of achievement in their field. “Extraordinary ability” means that the individual must “have risen to the very top of the field of endeavor.” This is demonstrated through copious evidence that establishes both that that the individual meets explicit threshold requirements and demonstrates that the individual has “sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise.” (link)
EB-1 Outstanding Professors and Researchers
The visa category "Professionals Under the North American Free Trade Agreement" (also known as a “TN Visa”) is available only to citizens of The EB-1 Outstanding Professor or Researcher category is a labor certification exempt immigrant visa category. This category enables businesses, universities and non-profit organizations that are engaged in research and development to sponsor their researchers for permanent residence. The category generally requires the employee to possess a doctoral degree or its foreign equivalent and a track record of outstanding achievement in a particular academic field. This is demonstrated through copious evidence (publications, citations, expert testimonials, etc.) that establishes both that that the individual meets explicit threshold requirements and demonstrates that the individual is recognized internationally as outstanding in his or her academic field. EB-2 National Interest Waiver (NIW)
The EB-2 NIW is a labor certification exempt immigrant visa category available both to self-petitioners and to businesses, universities and non-profit organizations seeking to sponsor employees that are engaged in work that is in the national interest. The category is intended for individuals that are engaged in work that is in an area of substantial intrinsic merit where the benefits of this work redound nationally if not internationally. Further, it must be demonstrated that the foreign national warrants waiver of the labor certification requirement through copious evidence that the individual possesses skills that are substantially beyond that of individuals with the same minimum qualifications and that the foreign national has had a degree of influence on the field that distinguishes them from their peers.
